O presente artigo visa uma análise jurídica sob o viés do Direito Sucessório acerca da Herança Digital e da ascensão do Metaverso. Nesse âmbito, aborda, especificamente, o surgimento do Metaverso e o possível patrimônio digital criado dentro dele pelo usuário e autor da herança, e a consequente consolidação do Direito Digital no Brasil. Foi utilizada a metodologia de investigação histórica e pesquisas jurídicas apoiadas no Direito de Sucessões, com o objetivo de visualizar possíveis caminhos a serem levados para a transmissão mortis causa de patrimônios digitais construídos no Metaverso por meio dos Tokens não fungíveis (NFTs). Conclui-se que a transmissão dos bens digitais figura como uma lacuna legislativa, vez que não há legislação específica para regulamentar tal procedimento. No momento, o que se constata é a possibilidade de analisar essas questões gerais com base no Código Civil e firmar entendimentos jurisprudenciais acerca das variações dos bens digitais, além de incentivar a prática do planejamento sucessório.

ABSTRACT
This article aims at a legal analysis under the bias of Inheritance Law about Digital Heritage and the rise of the Metaverse. In this context, it specifically addresses the emergence of the Metaverse and the possible digital heritage created within it by the user and author of the inheritance, and the consequent consolidation of Digital Law in Brazil. The methodology of historical investigation and legal research supported by the Law of Inheritance was used, with the objective of visualizing possible paths to be taken for the mortis causa transmission of digital assets built in the Metaverse through non-fungible Tokens (NFTs). It is concluded that the transmission of digital goods appears as a legislative gap, since there is no specific legislation to regulate this procedure. At the moment, what we see is the possibility of analyzing these general issues based on the Civil Code and establishing jurisprudential understandings about the variations of digital assets, in addition to encouraging the practice of succession planning.
